Assignment#5 IntheWeatherUndergroundCorporationlawsuitthecourtshoulddeterminethatthey lackpersonaljurisdictionoverthecase.Thereasonforthisisthatthereisnoevidencetosupport theprincipleofminimumcontactswithinthestateofMichigan.Furthermore,thecourtalsodoes nothavesubjectmatterjurisdictionoverthecaseaswell.Inordertoestablishpersonal jurisdictionminimumcontactmustbemetintheforumstate.Residentswithinthestateof Michiganwouldfallundertheauthorityofthecourt.Beingthatthedefendant,Navigation CatalystSystems,Incorporated(“NCS”),isaregisteredbusinessinthestateofDelawarethis eliminatesthefirstfinding.Additionally,NCSdoesnotownoroperateanysubsidiary company’sorremotecompanieswithinthestateofMichigan.Thisisanotherfactortoconsider whenexercisingpersonaljurisdiction.InordertoclaimjurisdictionoverNCSthecompany would havetobeconductinginstateactivity.Thisconditionisalsonotmetbeingthatthereisno correlationwithNCSandthestateofMichigan.EvenifNCShasitsproductsusedwithinthe stateitwouldnotbesufficientenoughtoestablishpersonaljurisdictionwithminimumcontact.PertheInternationalShoeCo.v.Washingtoncase,itwasdeterminedthathavingproductsin commercealoneisinefficientindeterminingminimumcontacts.Thispreventsasellerofa productfrombeingsuedwithinanotherstatesdistrictcourt.Astreamingagreementisabletoofferflexiblecontenttoissubscribers.Theagreement betweenApple,IncandMajorLeagueBaseballisonethatcanbebeneficialwithintheright parameters.Oneofthebiggestadvantagestoastreamingserviceistheaccesstocontenton demand.Thisisafeaturethatisprevalentthroughoutthestreamingindustry.Consumerswould
